Regulations on digital signature authentication services specifically for public use

The Government issued Decree 68/2024/ND-CP dated June 25, 2024 regulating digital signatures for official use.

This Decree provides detailed regulations on digital signature authentication services specifically for public use; The provision, management, and use of digital signatures specifically for public official use, digital signature certificates specialized for public official use, and digital signature authentication services specifically for public official use.

In particular, the Decree stipulates that specialized digital signature authentication services for public official purposes provided by organizations providing digital signature authentication services specialized for public official purposes include: 1. Creating and distributing key pairs. 2. Issue digital signature certificates specifically for official use. 3. Renew digital signature certificate for official use. 4. Change the information content of the digital signature certificate for official use. 5. Revoke digital signature certificates for official use. 6. Restore the device where the private key is stored. 7. Publish and maintain an online database of digital signature certificates specifically for public use. 8. Check online official digital signature certificate. 9. Issue a timestamp.

Validity period of digital signature certificate for official use

The Decree clearly stipulates that digital signature certificates for official use of organizations providing digital signature authentication services for official use have a validity period of 20 years.

The newly issued digital signature certificate for public official purposes is valid for a maximum of 5 years.

The subscriber's specialized digital signature certificate has its validity period extended to a maximum of 3 years.

For digital signature certificates specifically used for public service to issue and check passports with electronic chips, the validity period of the digital signature certificate is as prescribed in Article 23 of this Decree. For digital signature certificates specifically used for public service to issue and check identification cards with electronic chips, the validity period of the digital signature certificate is as prescribed in Article 26 of this Decree.

Conditions for new issue of digital signature certificate for public use v

1. Conditions for issuing new digital signature certificates for official use for individuals: Must be individuals of agencies and organizations specified in Article 2 of this Decree and have a need for electronic transactions; There is a written request from the direct management agency or organization.

2. Conditions for new issuance of digital signature certificates for official use to agencies and organizations: Must be agencies and organizations with legal status as prescribed in Article 2 of this Decree; There is a decision to establish an agency or organization or confirmation from the head of an immediate superior agency or organization; There is a written request from the direct management agency or organization.

3. Conditions for new issuance of digital signature certificates for official use for equipment, services, and software: Equipment, services, and software owned and managed by agencies and organizations with legal status specified in Article 2 of this Decree; There is a written request from the direct management agency or organization.

Conditions for renewing digital signature certificates for official use

The Decree stipulates that digital signature certificates for official use can only be renewed once and must be valid for at least 30 days.

Direct management agencies and organizations must submit a written request for extension of digital signature certificates for official use.

* Article 2. Subjects of application

1. Agencies and organizations belonging to state agencies; political organizations; social and political organizations; business units-public.

2. Cadres, civil servants, public employees, people working in the people's armed forces and people working in cipher organizations.

3. Other agencies, organizations and individuals related to the provision, management and use of digital signatures for official use, digital signature certificates for official use and digital signature authentication services specialized in public service.
