DECISION
Regulations on functions, tasks, powers and organizational structure of 
Department of Digital Transformation and Environmental Resources Data Information
MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies; Decree No. 101/2020/ND-CP dated August 28, 2020 of the Government amending and supplementing a number of articles of Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 68/2022/ND-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
Considering the proposal of the Director of the Department of Information Technology and Environmental Resources Data in Submission No. 15/TTr-CNTT dated October 13, 2022;
At the proposal of the Director of the Department of Organization and Personnel.
DECISION:
Article 1. Position and functions
1. The Department of Digital Transformation and Environmental Resources Data Information is an organization under the Ministry of Natural Resources and Environment, with the function of advising and assisting the Minister in unifying the management of information technology application activities, digital transformation, and
e-Government development towards digital government in the natural resources and environment sector; organizing the construction, management, and operation of information systems, national natural resources and environment database systems; archiving, information, documents, and libraries in the natural resources
and environment sector; providing public services in accordance with the law.
2. The Department of Digital Transformation and Environmental Resources Data Information has legal status, its own seal and account in accordance with the law, headquartered in Hanoi city.
Article 2. Duties and powers
1. Develop and submit to the Minister mechanisms, policies, legal documents, economic-technical norms, standards, technical regulations, processes, and regulations on the application of information technology, development of digital infrastructure, digital platforms, digital data platforms, databases and platforms, applications, and digital services; information security; archiving and information work, libraries of natural resources and the environment.
2. Develop and submit to the Minister strategies, planning, plans, programs, projects, and specialized tasks on the application of information technology, development of digital infrastructure, digital platforms, digital data platforms, databases and applications, and digital services; information security; archiving and information work, libraries of natural resources and the environment; and guide, inspect, and organize implementation after approval.
3. Guide and inspect the implementation of legal regulations on: information technology application activities; digital transformation, e-Government development towards digital Government, digital economy, digital society; information security, network security protection; archiving and information, natural resources and environment libraries at units in the natural resources and environment sector and related organizations. 4. Appraisal of technology
, technical solutions, professional expertise for information technology application, digital transformation, e-Government development towards digital Government; construction, management, operation, provision, exploitation,
use of digital infrastructure, digital data platforms, databases and platforms, applications, digital services; ensuring information security, network security protection; archiving and information, natural resources and environment sector libraries of units under the Ministry.
5. Guide, inspect, supervise the construction, acceptance, and evaluate the effectiveness of: the application of information technology, digital transformation, and development of e-Government towards digital Government; the construction and operation of digital infrastructure, digital data platforms, databases and platforms, applications, and digital services; ensuring information security, protecting network security; on archiving and information, documents, and libraries of the natural resources and environment sector under the authority and assignment of the Minister.
6. On the application of information technology, development of e-Government towards digital Government
a) Develop and perfect the working methods and processes of the natural resources and environment sector in the digital environment;
b) Develop, manage, operate, and update: e-Government Architecture, Digital Government Architecture of the Ministry; Electronic architecture applied to the fields of natural resources and environment; shared database system of natural resources and environment sector;
c) Building, managing and operating e-Government platforms towards digital Government, integrating, connecting and interoperating with platforms of the Government, ministries, branches and localities according to regulations;
d) Manage and guide the implementation of digital signatures, digital certificates, and digital signature authentication for specialized Government units under the Ministry;
dd) Organize the implementation of measurement, statistics, evaluation, and ranking of information technology application, digital transformation, and e-Government development towards digital Government in the natural resources and environment sector according to regulations; e
) Propose and participate in the appraisal of plans for leasing, investing, and centralized procurement of information technology services and equipment, platform application software, software with a large number of users, centralized digital infrastructure, and organize implementation according to the Minister's assignment;
g) Propose the allocation of resources for information technology application activities, digital transformation, and e-Government development towards digital Government in the natural resources and environment sector according to the Minister's assignment.
7. Regarding information and data on natural resources and environment
a) Guide and inspect the collection, construction, management, storage, operation, integration, connection, communication, exploitation, sharing, and use of information and data on natural resources and environment as assigned by the Minister;
b) Guide and appraise the construction, management, and development of data infrastructure, specialized and national databases to ensure the development of digital government; connection and sharing with national databases, specialized databases of ministries, branches and localities; analysis, processing, information services, digital data; provision, sharing, use, and opening of data in accordance with the provisions of law;
c) Build, manage, operate, collect, update, process, provide, and share data and information of national, aggregated, and shared database systems on natural resources and environment as assigned by the Minister;
d) Building, managing, operating data warehouses, big data and shared environmental resource data processing centers; developing, managing, mining, analyzing, and processing synthetic data and smart data to serve digital transformation, developing e-Government towards digital Government, digital economy of the natural resources and environment sector as assigned by the Minister; e) Building
, managing, administering, monitoring, and operating the Integrated Platform, sharing data of the natural resources and environment sector connected to the National Integrated Platform, sharing data, Integrated Platform, sharing data of ministries, branches, and localities; building, managing, and operating the Data Portal, Open Data Portal of natural resources and environment to provide data, open data, and shared data in accordance with legal regulations;
g) Organizing the implementation of design, integration, and connection of natural resources and environment data to meet the requirements of smart urban development as assigned by the Minister.
8. Regarding the development and operation of digital infrastructure
a) Build, manage and operate the digital infrastructure system and network infrastructure of the Ministry in a unified, connected and interconnected manner with the digital infrastructure of the Government, ministries, branches and localities according to regulations;
b) Building, managing, deploying, operating information security, connecting the Ministry's Data Centers. Managing and operating information security of cloud computing infrastructure, Internet of Things (IOT) connection infrastructure, data mining platforms and connecting with infrastructures of the Government, ministries, branches and localities;
c) Organizing the implementation of IPv6 conversion (6th generation internet protocol) for digital infrastructure, network systems, digital services and digital platforms of the Ministry.
9. Regarding digital platforms, applications and digital services
a) Being the focal point for managing, operating and connecting with digital platforms, applications and digital services of the Government, ministries, branches and localities according to the tasks of the Ministry of Natural Resources and Environment;
b) Organize the construction, development, and operation of digital platforms and digital applications for common use in big data mining, analysis, processing, synthesis, statistics, forecasting, and warning to serve digital transformation of the natural resources and environment sector as assigned by the Minister;
c) Build and develop digital platforms, applications, services, open platforms, and open ecosystems in digital transformation, develop e-Government towards digital Government of the natural resources and environment sector as assigned by the Minister;
d) Build, manage, deploy, and operate the Intelligent Monitoring and Operation Center System (IOC) connected to the national command and operation system, ministries, branches, and localities.
10. Regarding information security and safety
a) Organize the implementation of information security and network security protection; monitor and supervise the implementation of policies and laws on information security and network security protection; b) Preside over the implementation, guidance, inspection, supervision and assessment of information security and network information security; prevention of network attacks
; prevention and control of malware; response and remediation of network attacks on digital infrastructure systems, digital platforms, digital applications, data platforms and databases managed by the Ministry; c) Build, manage, deploy and
operate the Information Security Monitoring and Operation Center System, protect network security according to the four-layer model for information systems of ministries and sectors and connect and share information with the National Cyber ​​Security Monitoring System; d) Organize the appraisal,
approval or submission to competent authorities for approval of proposal documents and information security assurance plans; guide, inspect, and evaluate the work of ensuring information system security at the level of the Ministry's information system according to the provisions of law;
d) Organize the development, coordination, rehearsal, and training of response plans for risks and incidents of network information security loss
11. On digital economy and digital society
a) Organize the implementation of tasks and solutions for developing the digital economy and digital society according to the National Strategy on developing the digital economy and digital society as assigned by the Minister;
b) Organize the development and implementation of applications, digital content services, digital businesses that effectively exploit the digital ecosystem of resources and environment, contributing digital platforms for the development of the digital economy and digital society in the natural resources and environment sector as assigned by the Minister.
12. Organize the implementation, deployment, and operation of smart solutions in monitoring, supervision, management, warning, and processing of information and data on natural resources and the environment as assigned by the Minister.
13. Regarding archiving, information, documents and libraries
a) Inspect and provide professional guidance on the implementation of legal provisions on archiving and specialized electronic archiving as prescribed. Organize the implementation of management, storage, preservation, and provision of natural resources and environmental documents and materials as assigned by the
Minister.
b) Preside over and coordinate the announcement of the list of data and information on natural resources and the environment on the Ministry's electronic information portal;
c) Collect, update, register, store and publish information on the tasks and results of applying scientific and technological tasks of the Ministry as assigned by the Minister;
d) Preside over the implementation of library work in the natural resources and environment sector, including electronic libraries and related books, documents and materials as assigned by the Minister; develop information sources between information agencies - libraries on natural resources
and the environment.
14. Preside over and coordinate with relevant units to publicize, publish, provide, share and use information, documents, data and open data on natural resources and the environment with state management agencies, organizations and individuals at home and abroad as prescribed by law and as assigned by the Minister.
15. Monitor, evaluate and report on information technology application activities, digital transformation, e-Government development towards digital Government, digital Government and information security; archiving and information work, libraries of natural resources and environment sector according to regulations. 16.
Be the focal unit of the Ministry to organize and coordinate the implementation of the National Strategy, Program and Project on Digital Transformation, e-Government development towards digital Government, digital economy and digital society development, smart urban development, national data development, cyberspace safety and security; Fourth Industrial Revolution, artificial intelligence, electronic document storage and related national strategies, programs and projects as assigned by the Minister.
17. Organize scientific research, technology transfer, international cooperation, implement international cooperation programs and projects on information technology application, digital transformation, e-Government development towards digital Government, digital economy, digital society; develop digital infrastructure, digital platform, digital services, digital data platform, database and information security, protect network security; archiving and information, library of natural resources and environment sector as assigned by the Minister.
18. Guide and support the Department of Natural Resources and Environment of provinces and centrally run cities on information technology application, digital transformation, e-Government development towards digital Government; develop digital infrastructure, digital platform, digital services, digital data platform, database; information security; archiving and information, library of natural resources and environment.
19. Organize the implementation of services and consulting on: application of information technology; digital transformation; development of Government, e-Government, digital Government; development of digital infrastructure, digital platform, digital application, digital service, digital data platform, information system, database; information security; archiving and information of documents, libraries of the natural resources and environment sector according to the provisions of law.
20. Coordinate with relevant agencies and units to propagate and disseminate contents, legal policies, raise awareness of digital transformation, e-Government towards digital Government, digital economy, digital society as assigned by the Minister. Organize training on application of information technology, digital knowledge, skills and information security in digital transformation, development of e-Government towards digital Government; archiving and information of documents, libraries of the natural resources and environment sector as assigned by the Minister.
21. Organize the implementation of administrative reform according to the Ministry's administrative reform program and plan.
22. Manage the organization, payroll, job positions, civil servants, public employees, and workers of the Department according to the decentralization of the Ministry of Natural Resources and Environment and according to the provisions of law; coordinate with the Department of Organization and Personnel in building and developing the organizational system, human resources in applying information technology, digital transformation, and data information in the natural resources and environment sector.
23. Manage finance and assets assigned by the State; perform the responsibilities of a level II budget unit for units under the Department according to the provisions of law.
24. Perform other tasks assigned by the Minister.
Article 3. Leadership of the Department
1. The Department of Digital Transformation and Environmental Resources Data Information has a Director and no more than 03 Deputy Directors.
2. The Director is responsible to the Minister for assigned tasks; issues individual documents, professional and technical guidance documents according to assigned functions and tasks and other documents according to the decentralization and authorization of the Minister; issues working regulations and manages the activities of the Department. 3. Deputy
Directors assist the Director and are responsible to the Director for assigned areas of work.
Article 4. Organizational structure
1. Digital Transformation Department.
2. Department of Natural Resources and Environment Data.
3. Department of Planning - Finance.
4. Department of Science - Technology and Information Security.
5. Office.
6. National Center for Information, Archives and Library of Natural Resources and Environment.
7. Center for Infrastructure and Information Security.
8. Center for Software Technology and Digital Platform.
9. Center for Testing Information Technology Products.
10. Southern Center for Information Technology Application and Data (headquartered in Ho Chi Minh City).
The Office and the organizations specified in Clauses 6 to 10 of this Article are level III budget units, have their own seals, and are allowed to open accounts at the State Treasury and banks in accordance with the provisions of law.
The Director of the Department of Digital Transformation and Environmental Resources Data Information shall submit to the Minister the regulations on the functions, tasks, powers and organizational structure of public service units under the Department; issue a Decision regulating the functions, tasks, powers and organizational structure of the Office and departments under the Department.
Article 5. Effectiveness and responsibility for implementation
1. This Decision takes effect from January 1, 2023.
2. This Decision replaces Decision No. 1168/QD-BTNMT dated May 16, 2017 of the Minister of Natural Resources and Environment stipulating the functions, tasks, powers and organizational structure of the Department of Information Technology and Environmental Resources Data. 3. The units
specified in Clauses 6 to 10, Article 4 shall continue to perform their functions, tasks and powers according to current regulations until the Decision on functions, tasks, powers and organizational structure is issued by the Minister and takes effect.
4. The Chief of the Ministry's Office, Director of the Department of Organization and Personnel, Director of the Department of Digital Transformation and Environmental Resources Data Information and Heads of agencies and units under the Ministry are responsible for implementing this Decision./.
